GiftWeGo Affiliate Program Terms and Conditions

1. Introduction
1.1 Parties
These Affiliate Program Terms and Conditions (hereinafter "Terms") govern the relationship between:
- Operator: Ondřej Smutný, ID: 75343533, Družstevní 511, 294 41 Dobrovice, Czech Republic (hereinafter "GiftWeGo", "Operator" or "we")
- Affiliate Partner: Any individual or entity registered in the GiftWeGo Affiliate Program (hereinafter "Partner" or "you")
1.2 Purpose
The GiftWeGo Affiliate Program allows Partners to promote GiftWeGo services through unique referral links and earn commissions on qualifying purchases made by referred customers.
1.3 Acceptance
By registering for the Affiliate Program, you confirm that you have read, understood, and agree to these Terms in their entirety. If you do not agree, do not register.
2. Registration and Approval
2.1 Application
Registration requires:
- A valid GiftWeGo user account
- A completed application form with truthful and complete information
- Approval by the Operator
2.2 Approval Process
- Each application is reviewed individually and at the sole discretion of the Operator.
- The Operator reserves the right to reject any application without providing a reason.
- There is no legal entitlement to acceptance into the Affiliate Program.
2.3 Referral Code
Upon approval, Partner will receive an automatically generated unique referral code. This code is non-transferable and serves to identify commissions attributable to the Partner.
3. Commissions and Payment
3.1 Commission Rates
Commissions are calculated as a percentage of the net purchase amount (excluding VAT, payment gateway fees, and discounts):

3.2 Rate Changes
The Operator reserves the right to change commission rates at any time without prior notice. Changes apply to transactions occurring after the effective date.
3.3 Attribution
Commissions are attributed via first-click attribution through an HttpOnly cookie with a 30-day validity period.
3.4 Lockdown Period
Each commission is subject to a 30-day lockdown period from the transaction date. During this period, commissions may be automatically voided if the customer requests a refund, or rejected by the Operator for reasons outlined in Section 5.
3.5 Minimum Payout
Payout is available upon reaching a minimum balance in the respective currency: 500 CZK, $20 USD, or €20 EUR.
3.6 Payout Method
Payouts are made via bank transfer or through a payment service (e.g., Wise, Revolut) based on details provided by the Partner in their affiliate account settings. Commissions are recorded in the currency in which the customer made the purchase (CZK, EUR, or USD). The specific payout method is handled individually.
The Partner is responsible for the accuracy of the provided payment details.
3.7 Transfer Fees
All fees associated with the payout transfer are borne by the Partner. These include but are not limited to:
- Bank transfer fees (domestic and international)
- Currency conversion fees (exchange rates)
- Payment service fees (Wise, Revolut, etc.)
- Recipient bank fees
These fees are determined and charged by the respective financial institutions, not by the Operator. GiftWeGo has no control over and bears no responsibility for these fees.
The amount displayed in the affiliate dashboard represents the gross commission amount in the purchase currency (CZK, EUR, or USD). The actual amount credited to the Partner's account may be lower due to the aforementioned transfer and currency conversion fees. GiftWeGo does not guarantee any specific exchange rate or third-party fee amounts.
3.8 Payout Processing
- Payouts are processed manually and typically within 30 business days of an approved payout request.
- The Operator reserves the right to withhold, delay, or decline any payout in cases of suspected violation of these Terms, fraudulent activity, or any other unauthorized conduct, at the Operator's sole discretion.
- The Operator is not obligated to pay commissions where there is any suspicion of improper conduct, even without proof of such conduct.
4. Partner Obligations
4.1 Permitted Methods
Partners may promote GiftWeGo exclusively through the following methods:
- Personal websites, blogs, and content platforms
- Social media (personal and business profiles)
- YouTube and other video platforms
- Podcasts
Promotion through emails (including newsletters) is expressly prohibited. The Operator does not wish to be associated with unsolicited communications or any communication channels outside its control.
4.2 Prohibited Methods
Partners must not under any circumstances:
- Send emails — any promotion via emails, newsletters, or messages (even to own subscribers) is prohibited
- Spam — unsolicited bulk messages or comments on social media, forums, etc.
- Cookie stuffing — loading referral links without the visitor's knowledge
- Incentivized clicks — paying or rewarding users for clicking referral links
- Impersonation — creating the impression of being an official GiftWeGo representative or employee
- Misleading advertising — making false, misleading, or exaggerated claims about GiftWeGo
- Unauthorized discounts — promising discounts or benefits not approved by GiftWeGo
- Link manipulation — redirecting, cloaking, or otherwise tampering with referral URLs
- Self-referral — registering or purchasing through one's own referral link
- Brand bidding — purchasing PPC ads on keywords containing "GiftWeGo" without written consent
- Legal violations — any promotion violating applicable laws, regulations, or third-party rights
4.3 Affiliate Disclosure
Partners must comply with all applicable disclosure requirements (including FTC Guidelines and EU regulations) by clearly labeling affiliate links and using the rel="sponsored" attribute on all affiliate links.
4.4 Tax Obligations
Partners are fully responsible for all tax obligations arising from affiliate program income.
5. Fraud, Violations, and Penalties
5.1 Definition of Fraud
Fraudulent conduct includes but is not limited to:
- Generating artificial clicks, impressions, or conversions
- Self-referral transactions
- Cookie stuffing and cookie injection
- Use of bots, scripts, or automated tools to generate traffic
- Manipulation of statistics or tracking mechanisms
- Conducting conversions from VPN, proxy, or datacenter IP addresses to conceal identity
- Repeatedly creating accounts to circumvent program restrictions
- Any other activity that the Operator, in its sole and absolute discretion, considers suspicious, unfair, or contrary to the spirit of the program
5.2 Investigation and Suspension
- The Operator actively monitors affiliate activities using automated fraud detection systems.
- Upon any suspicion of fraudulent or improper conduct — even without specific evidence — the Operator may:
- Immediately suspend the Partner's affiliate account
- Freeze all unpaid commissions
- Initiate an internal investigation without obligation to inform the Partner of its progress
5.3 Penalties
Upon discovery of or suspicion of violation, the Operator may at its sole discretion:
- Void unpaid commissions — all commissions in any status (pending, approved, payable) may be permanently declared invalid
- Permanent ban — terminate the partnership immediately and permanently block the Partner's account and email
- Clawback — demand return of previously paid commissions if subsequently found to have been obtained through fraudulent conduct
- Reporting — in cases of serious suspected criminal activity, contact the appropriate authorities
5.4 Operator's Decision
All decisions by the Operator regarding the assessment of fraudulent conduct, Terms violations, and the granting or denial of commissions are final and not subject to appeal. The Operator is not required to provide reasons for or evidence supporting its decisions.
5.5 Partner Liability
Partners bear full responsibility for all activities conducted through their affiliate account, including activities of third parties acting on their behalf or with their knowledge.
6. Operator's Rights
6.1 Program Changes
The Operator reserves the right to at any time and without prior notice:
- Change commission rates, reward structures, or minimum payouts
- Modify, suspend, or terminate the Affiliate Program entirely
- Change technical tracking parameters (cookie duration, attribution model)
6.2 Termination by Operator
The Operator may terminate the partnership at any time, for any reason or no reason, with immediate effect. Upon termination:
- Partner forfeits all commissions not approved as of the termination date
- Approved but unpaid commissions may or may not be paid at the Operator's discretion
- Partner must promptly remove all affiliate links from their platforms
6.3 Voluntary Termination by Partner
The Partner may voluntarily terminate their participation in the Affiliate Program at any time through the affiliate dashboard settings. Upon voluntary termination:
- All unpaid commissions (including approved ones) are irrevocably forfeited and the Partner loses all entitlement to them
- The referral code ceases to function immediately
- The Partner must remove all affiliate links from their platforms
- The Partner's GiftWeGo user account is not affected — only the affiliate partnership is terminated
6.4 Monitoring
The Operator has the right to monitor all Partner affiliate activities, inspect Partner's websites and platforms, and request information and evidence regarding promotional methods.
7. Limitation of Liability
7.1 No Income Guarantee
GiftWeGo provides no guarantee regarding affiliate program earnings.
7.2 Service Availability
GiftWeGo does not guarantee uninterrupted availability of the affiliate system or tracking mechanisms.
7.3 Liability Cap
The Operator's total liability to the Partner for any claims arising from the Affiliate Program is limited to the amount of commissions actually paid in the preceding 12 months, up to a maximum of 10,000 CZK.
8. Intellectual Property
The Operator grants Partners a limited, non-exclusive, non-transferable, and revocable license to use the GiftWeGo name, logo, and promotional materials solely for affiliate promotion purposes. Partners may not modify GiftWeGo branding without prior written consent.
9. Data Protection
Personal data processing within the Affiliate Program is governed by the GiftWeGo Privacy Policy. Partners must not collect, store, or process GiftWeGo customer personal data beyond what is necessary for affiliate link functionality.
10. Final Provisions
10.1 Governing Law
These Terms are governed by the laws of the Czech Republic. Disputes shall be resolved by the competent courts of the Czech Republic.
10.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
10.3 Amendments
The Operator reserves the right to amend these Terms at any time. Continued participation constitutes acceptance of amended Terms.
10.4 Entire Agreement
These Terms constitute the entire agreement between the Operator and the Partner regarding the Affiliate Program.
Confirmation and Consent
By registering for the GiftWeGo Affiliate Program, you confirm that:

✓ You agree to these Terms in their entirety
✓ You are at least 18 years old (or have parental/guardian consent)
✓ The information you provided is truthful and complete
✓ You will not promote GiftWeGo through emails or unsolicited messages
✓ You will comply with all applicable laws and regulations
✓ You acknowledge that the Operator may at any time and without reason reject commissions, suspend your account, or terminate the partnership
✓ You acknowledge that all decisions by the Operator regarding fraudulent conduct are final
