This version is effective from: 14 October 2026 · Previous version: terms effective before 14 October 2026
1. Introduction
1.1 Parties
These Affiliate Program Terms and Conditions (hereinafter "Terms") govern the relationship between:
- Operator: Ondřej Smutný, ID: 75343533, Libichov 73, 294 42 Dobrovice, Czech Republic (hereinafter "GiftWeGo", "Operator" or "we")
- Affiliate Partner: Any individual or entity registered in the GiftWeGo Affiliate Program (hereinafter "Partner" or "you")
1.2 Purpose
The GiftWeGo affiliate program allows Partners to promote GiftWeGo through unique referral links and to earn commissions on payments by referred customers for the products listed in Section 3.1. The program is intended for the Partner's business activity; the Partner is not an employee or representative of GiftWeGo.
1.3 Acceptance
By registering for the Affiliate Program, you confirm that you have read, understood, and agree to these Terms in their entirety. If you do not agree, do not register.
2. Registration and Approval
2.1 Application
Registration requires:
- A valid GiftWeGo user account
- A completed application form with truthful and complete information
- Approval by the Operator
2.2 Approval Process
- Each application is reviewed individually and at the sole discretion of the Operator.
- The Operator reserves the right to reject any application without providing a reason.
- There is no legal entitlement to acceptance into the Affiliate Program.
2.3 Referral Code
Upon approval, Partner will receive an automatically generated unique referral code. This code is non-transferable and serves to identify commissions attributable to the Partner.
3. Commissions and Payment
3.1 What Earns a Commission and Commission Rates
A commission is earned only on payments by a customer referred by the Partner (Section 3.3) for the following products:
| Customer payment | Commission |
|---|---|
| GiftWeGo Plus – first annual payment | 30% |
| GiftWeGo Plus – renewal after the first year (2nd payment) | 10% |
| GiftWeGo Plus – renewal after the second year (3rd payment) | 10% |
| GiftWeGo Plus – further renewals | no commission |
| Lifetime GiftWeGo Plus (one-off payment) | 30%; if the customer previously paid for annual Plus with a commission, the payment is treated as a renewal (10%, see below) |
| Christmas Pass – the customer's first payment for the Christmas Pass | 20% |
- GiftWeGo Plus: a commission is earned on at most three payments of one customer – the first payment and two renewals made within two years of the first payment (with a 31-day tolerance for late renewal payments). If the customer takes out a new Plus subscription within this period (e.g. after cancelling) or buys Lifetime Plus, the payment is treated as a renewal. The first commission must arise from the first payment of a subscription, not from a renewal of a subscription taken out before the customer was assigned to the Partner.
- Christmas Pass: a commission is earned only on the customer's first payment for the Christmas Pass; no commission is earned on further Pass purchases (e.g. in a following season). Commissions on the Christmas Pass apply to payments made from the effective date of this version (14 October 2026).
- No commission is earned on other GiftWeGo products and services (credits, single vouchers and the voucher bundle, Cloud Storage, Premium, business codes, template activations, etc.).
The commission base is the amount the customer actually paid for the payment concerned (after any discount, e.g. from a discount code). The Operator is not registered for VAT, so the price contains no VAT and the commission base is not reduced by VAT; payment gateway fees are not deducted from the base. The commission is recorded in the currency of the payment (CZK, EUR or USD).
In particular, no commission is earned:
- on a payment the customer did not pay (e.g. a 100% discount), or on Plus granted by the Operator free of charge or manually,
- on Plus provided as part of a business (Premium) subscription and on Plus benefits carried over from an earlier Cloud Storage subscription,
- on payments by the Partner or persons acting for the Partner's benefit (self-referral, Section 4.2 item 9),
- if, at the time of payment, the Partner's affiliate account is not approved, is suspended, or has a high fraud-suspicion score (Section 5).
3.2 Rate Changes
The Operator may change commission rates. A change applies only to payments made after its effective date; commissions already earned remain unaffected. We will announce rate reductions in advance in the affiliate panel or by email. The Operator may set an individual rate for GiftWeGo Plus for a Partner (between 0 and 50%); the individual rate is shown to the Partner in the affiliate panel.
3.3 Attribution – Assigning a Customer to the Partner
- After a click on a referral link, an HttpOnly tracking cookie
gw_refvalid for 30 days is stored in the visitor's browser (first-click attribution – the first click decides; further clicks do not change the assignment) – only if the visitor has consented to marketing cookies in the cookie banner (also later during the same visit). - If the visitor signs up while the cookie is valid, their user account is assigned to the Partner permanently. A commission on their payments under Section 3.1 is earned even if they pay later.
- An existing user (account created before the click) who signs in while the cookie is valid is assigned to the Partner only for payments made within 30 days of the click.
- Renewal commissions belong to the Partner who received the commission on that customer's first payment.
- The Partner cannot be assigned to themselves: the Partner's own account (same account or email) is never assigned.
- Storing and reading the tracking cookie requires the visitor's consent under Art. 5(3) of Directive 2002/58/EC (ePrivacy), implemented in Section 89(3) of Czech Act No. 127/2005 Coll. on Electronic Communications. Without consent, nothing is stored on the visitor's device and the referral code is carried only in the page address for the duration of the visit: if the visitor signs up (signs in) during the same visit, their account is assigned to the Partner under the rules above; otherwise no assignment takes place and no commission is earned. If the visitor withdraws consent, the cookie is deleted. The Partner acknowledges that for this reason not every conversion may be captured, that the Operator may not track without the visitor's consent, and that the Partner must not pressure visitors into consenting or circumvent the cookie banner.
- The Partner is responsible for the correct use of referral links. The Operator is not responsible for technical issues on the Partner's side.
3.4 Lockdown Period, Withdrawal and Refunds
Each commission is subject to a 30-day lockdown period from the payment date. During this period the commission is "pending" and cannot be paid out, and the Operator may reject it for reasons outlined in Section 5.
If the customer withdraws from the contract (consumers within 14 days) or the Operator refunds a payment in full or in part, the commission is reduced proportionally to the refunded part of the payment; if the whole payment is refunded, the commission lapses. This also applies after the lockdown period. If the affected commission has already been paid out, the Operator will offset the difference against the Partner's future commissions or ask the Partner to return it.
3.5 Minimum Payout
Payout is available upon reaching a minimum balance in the respective currency: 500 CZK, $20 USD, or €20 EUR.
3.6 Payout Method
Payouts are made by bank transfer or via Wise based on details provided by the Partner in their affiliate account settings. The Partner requests the payout of approved commissions in the affiliate panel. Commissions are recorded in the currency in which the customer made the purchase (CZK, EUR, or USD). The specific payout method is handled individually.
The Partner is responsible for the accuracy of the provided payment details.
3.7 Transfer Fees
All fees associated with the payout transfer are borne by the Partner. These include but are not limited to:
- Bank transfer fees (domestic and international)
- Currency conversion fees (exchange rates)
- Payment service fees (e.g. Wise)
- Recipient bank fees
These fees are determined and charged by the respective financial institutions, not by the Operator. GiftWeGo has no control over and bears no responsibility for these fees.
The amount displayed in the affiliate dashboard represents the gross commission amount in the purchase currency (CZK, EUR, or USD). The actual amount credited to the Partner's account may be lower due to the aforementioned transfer and currency conversion fees. GiftWeGo does not guarantee any specific exchange rate or third-party fee amounts.
3.8 Payout Processing
- We process payouts manually, usually within 30 business days of the payout request.
- Where there is a reasonable suspicion of a breach of these Terms or of fraud (Section 5), we may suspend the payout of the commissions concerned until the matter is clarified. We will inform the Partner and give them the opportunity to respond.
3.9 Cancellation by the Customer and End of the Partnership
- If the customer cancels the Plus subscription, commissions on payments already made remain (subject to Section 3.4); no commission is earned on renewals that no longer take place. The same applies if a renewal payment cannot be collected.
- If the Partner leaves the program, or the Partner's account is suspended or the partnership is terminated (Section 6), no commission is earned on payments made after that day.
3.10 Transitional Provisions
- The commission rules under Section 3.1 apply from the launch of GiftWeGo Plus (13 October 2026), commissions on the Christmas Pass under the last item. Until that day, the previous version applied (commissions on credits, gift vouchers, Cloud subscription, business codes and templates).
- Commissions earned before the launch of GiftWeGo Plus remain in their current state (pending, approved and paid). They are approved, paid out and, if applicable, voided (refunds) under the previous rules and are added to the balance together with other commissions.
- Commissions on the Christmas Pass (Section 3.1) are earned on payments made from the effective date of this version (14 October 2026).
4. Partner Obligations
4.1 Permitted Methods
Partners may promote GiftWeGo exclusively through the following methods:
- Personal websites, blogs, and content platforms
- Social media (personal and business profiles)
- YouTube and other video platforms
- Podcasts
Promotion through emails (including newsletters) is expressly prohibited. The Operator does not wish to be associated with unsolicited communications or any communication channels outside its control.
4.2 Prohibited Methods
Partners must not under any circumstances:
- Send emails — any promotion via emails, newsletters, or messages (even to own subscribers) is prohibited
- Spam — unsolicited bulk messages or comments on social media, forums, etc.
- Cookie stuffing — loading referral links without the visitor's knowledge
- Incentivized clicks — paying or rewarding users for clicking referral links
- Impersonation — creating the impression of being an official GiftWeGo representative or employee
- Misleading advertising — making false, misleading, or exaggerated claims about GiftWeGo
- Unauthorized discounts — promising discounts or benefits not approved by GiftWeGo
- Link manipulation — redirecting, cloaking, or otherwise tampering with referral URLs
- Self-referral — registering or purchasing through one's own referral link
- Brand bidding — purchasing PPC ads on keywords containing "GiftWeGo" without written consent
- Legal violations — any promotion violating applicable laws, regulations, or third-party rights
4.3 Affiliate Disclosure
Partners must comply with all applicable disclosure requirements (including FTC Guidelines and EU regulations) by clearly labeling affiliate links and using the rel="sponsored" attribute on all affiliate links.
4.4 Tax Obligations
Partners are fully responsible for all tax obligations arising from affiliate program income.
5. Fraud, Violations, and Penalties
5.1 Definition of Fraud
Fraudulent conduct includes but is not limited to:
- Generating artificial clicks, impressions, or conversions
- Self-referral transactions
- Cookie stuffing and cookie injection
- Use of bots, scripts, or automated tools to generate traffic
- Manipulation of statistics or tracking mechanisms
- Conducting conversions from VPN, proxy, or datacenter IP addresses to conceal identity
- Repeatedly creating accounts to circumvent program restrictions
- Any other similar activity aimed at earning a commission without a genuine customer referral
5.2 Monitoring and Suspension
- The Operator also monitors affiliate activity automatically (e.g. the number of clicks from one IP address, the time between click and purchase, a fraud-suspicion score). No commission is earned by an account with a high fraud-suspicion score.
- Where there is a reasonable suspicion of fraudulent or unfair conduct, the Operator may suspend the affiliate account and the payout of unpaid commissions until the matter is clarified. It will inform the Partner by email without undue delay, state the reason and give the Partner the opportunity to respond.
5.3 Penalties
If a breach of these Terms is established, the Operator may, depending on its seriousness:
- reject the commissions that arose from the breach (in case of serious fraud, all unpaid commissions),
- terminate the partnership with immediate effect and block the Partner's affiliate account,
- demand the return of commissions already paid that were obtained through fraud or a breach of the Terms (clawback),
- contact the competent authorities if a criminal offence is suspected.
5.4 Operator's Decision
The Operator decides on a penalty after assessing the available information and the Partner's response. It will communicate the decision to the Partner by email, including the reasons. If the Partner disagrees, they may request a review at info@giftwego.com; this does not affect their right to go to court.
5.5 Partner Liability
Partners bear full responsibility for all activities conducted through their affiliate account, including activities of third parties acting on their behalf or with their knowledge.
6. Operator's Rights
6.1 Program Changes
The Operator may change the program (rates, promoted products, minimum payout, tracking parameters) or end it. Changes apply only to payments after their effective date; commissions already earned remain unaffected. We will announce changes unfavourable to the Partner and the end of the program in advance in the affiliate panel or by email, as a rule at least 15 days in advance.
6.2 Termination by Operator
- The Operator may terminate the partnership with 15 days' notice, and with immediate effect in case of a serious breach of the Terms (Section 5).
- On termination without a breach of the Terms, we will pay the Partner approved commissions and commissions approved after the lockdown period, provided they reach the minimum payout (Section 3.5).
- After termination, the Partner must remove affiliate links from their platforms without undue delay.
6.3 Voluntary Termination by Partner
The Partner may leave the program at any time in the affiliate panel settings. On voluntary termination:
- Request a payout before leaving of approved commissions that have reached the minimum payout (Section 3.5). Leaving deletes the affiliate account and unpaid commissions (pending and approved) lapse.
- The referral code stops working immediately and click records are deleted.
- The Partner must remove affiliate links from their platforms.
- The Partner's GiftWeGo user account is not affected – only the affiliate partnership ends.
6.4 Monitoring
The Operator has the right to monitor all Partner affiliate activities, inspect Partner's websites and platforms, and request information and evidence regarding promotional methods.
7. Limitation of Liability
7.1 No Income Guarantee
GiftWeGo provides no guarantee regarding affiliate program earnings.
7.2 Service Availability
GiftWeGo does not guarantee uninterrupted availability of the affiliate system or tracking mechanisms.
7.3 Liability Cap
The Operator's total liability to the Partner for claims arising from the affiliate program is limited to the commissions paid to the Partner in the last 12 months, but no more than CZK 10,000. The limitation does not apply to damage caused intentionally or by gross negligence, or to the claim to payment of commissions already approved.
8. Intellectual Property
8.1 Licence to Promotional Materials
The Operator grants the Partner a limited, non-exclusive, non-transferable and revocable licence to use the GiftWeGo name, logo and other promotional materials solely for affiliate promotion and in accordance with the Operator's guidelines.
8.2 Restrictions
The Partner may not modify, adapt or change the GiftWeGo logo, name or other brand elements without the Operator's prior written consent.
9. Data Protection
The processing of personal data of Partners and of visitors from referral links is described in the GiftWeGo Privacy Policy (in particular Sections 2.12 and 8.2). The Partner undertakes not to collect, store or process personal data of GiftWeGo customers beyond what is necessary for affiliate links to work.
The tracking cookie gw_ref is stored and read on the visitor's device only with their consent to marketing cookies (Section 89(3) of Czech Act No. 127/2005 Coll.) – see Section 3.3. We record clicks with a hash of the IP address, not the IP address itself, and the record is deleted after 30 days. The Partner does not receive personal data of GiftWeGo customers; in the affiliate panel they see only aggregate data (number of clicks, product type, amount and commission status).
10. Final Provisions
10.1 Governing Law
These Terms are governed by the laws of the Czech Republic. Disputes are decided by the Operator's general court (the District Court in Mladá Boleslav, or the Regional Court in Prague); if the Partner is a consumer, jurisdiction follows the law.
10.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
10.3 Amendments
We publish a new version of the Terms on this page with its effective date and a link to the previous version; Sections 3.2 and 6.1 apply to changes of rates and the program. If the Partner does not agree with a change, they may leave the program (Section 6.3). By continuing to participate after the change takes effect, the Partner accepts it. We store the version of the Terms with the consent given in the application.
10.4 Entire Agreement
These Terms constitute the entire agreement between the Operator and the Partner regarding the Affiliate Program.
